Debt collection practices

Is it legal for a debt collector to LIE to you and threaten you? We had a collector lie to my husband by telling him that legal papers had been served and tell him if he didn’t show up for court he could be put in jail. I told him that if legal papers had been served it would be an attorney’s office calling him and that they couldn’t put him in jail for a debt. But is that something that collectors are allowed to do??

Answer:
I have never heard nor read of a judge ordering the defedant to appear to the initial proceedings. I am sure if I am wrong, someone with attorney’s knowledge should correct me. You can be ordered by the judge in other ways but that is after the court stuff is in full swing and you would know that first hand. To have a bottom-of-the-food-chain collection agent tell you that is moot, because it would be very unlikely for him to have that kind of knowledge before you would.
So based on what you had posted – again I do believe they have voilated.
